Cable Operator Launches National Ads Claiming Its HD Image Tops DirecTV’s, EchoStar’s

Comcast launched a broadside in the HD superiority wars against direct-broadcast satellite.

In a new series of national print and radio ads, Comcast cited the results of a side-to-side comparison from a polling the company commissioned by Frank N. Magid Associates indicating that Comcast delivers a better HD image than DirecTV or EchoStar Communications’ Dish Network. The polling was conducted in March, including 309 people in the survey, according to Comcast.

Participants were asked if they saw a difference in quality between HD pictures on unlabled sets carrying images from Comcast, DirecTV and Dish. According to the survey, among those who expressed a preference, 65.6% picked Comcast over DirecTV and 69.92% picked Comcast over Dish.

The ads will also counter DirecTV’s claims it has more HD channels available. One ad stated that on April 24 at 9:17 p.m., Philadelphia viewers could select from among 16 HD channels on DirecTV but had 200 choices on Comcast, including PBS and MyNetwork TV affiliates unavailable from the competition. The Comcast count included 180 on-demand selections.

This is just the latest salvo by an operator against claims by DBS companies that they will offer more channels and offer better signal quality than cable TV.

A federal false-advertising suit is pending in U.S. District Court in New York brought by Time Warner Cable against DirecTV. That operator was granted an injunction that bars DirecTV from airing a TV ad claiming that its HD quality is better than cable until the false-advertising claim can be adjudicated.

Time Warner was refused a second injunction request against an ad, featuring actor Christopher Lloyd in his character from the Back to the Future films, claiming that DirecTV will soon have more HD channels than cable. Judge Laura Taylor Swain said the ad as a whole wasn’t false because the firm used the term “soon.”




EchoStar Answers the High Def Call

DISH Network subscribers have had to listen to all of the stories about DIRECTV’s highly-anticipated HDTV expansion and wonder whether they made the wrong decision about which satellite service would provide the most high-def programming. But after EchoStar held its DISH Network Team Summit last week in Dallas, news has hit the streets that the nation’s second largest satellite company has plans of its own to make a serious high-def push in the very near future.

According to sources from the event, EchoStar CEO Charlie Ergen said that his company will be launching two new satellites sometime later this year to greatly expand its high-definition capacity. The news made its way through a handful of industry press reports and internet message boards, and eventually got picked up by The Rocky Mountain News.

At DISH’s annual dealer event, Ergen reportedly vowed that EchoStar would remain the industry’s HD leader after telling attendees the company would launch two new satellites by the end of the year. Currently, DISH Network carries 32 national high-def channels, more than any other pay-TV provider today.

As of press time, EchoStar had not responded to SkyREPORT’s requests for comment.

In other DISH news, the satcaster said that along with Canadian satellite company Bell ExpressVu and security partner NagraStar, the companies are pursuing alleged satellite pirates north of the border. According to DISH, a Superior Court of Justice in Quebec issued injunctions that allege two web sites were operating to provide consumers with instructional information on how to use piracy technology. Together, the companies have filed civil suits for $5 million against the sites highontech.com and maestro.tv.




FCC OKs DBS Reverse Band

On Friday, the Federal Communications Commission adopted service rules for the so-called DBS reverse band, a new set of spectrum resources that would allow for an expansion of satellite TV capacity.

Specifically, the spectrum, also known as the 17/24 GHz BSS Band, will allow for the delivery of high-def and standard definition video, some data and video-on-demand and interactive content. In most cases, the spectrum will allow companies to complement their existing DBS services.

As part of its effort, the FCC adopted a first-come, first-served licensing procedure for the reverse band as well as other licensee obligations, such as geographic service rules that require licensees to provide service to Alaska and Hawaii. Also, the FCC established limits for uplink and downlink power levels to minimize the possibility of harmful interference.

In addition, the commission initiated further notice of proposed rulemaking to address technical issues related to potential interference.

In its order, the FCC identified four companies with license applications before the commission for use of the reverse band: DIRECTV, EchoStar, Pegasus and Intelsat North America. The agency also said it will attempt to accommodate other qualified applicants.
